EBC VERDICT: Refuse Planning Permission
  1. The proposed development would, by virtue of its design, appearance, scale, bulk and mass, would result in a dominant and incongruous form of development that would cause an unacceptable harm to the character and appearance of the host dwelling, surrounding area and street scene. As such, the proposal would be contrary to Policies CS11, CS17 of the Core Strategy 2011, Policy DM2 of the Development Management Plan 2015 and the NPPF 2024.
  2. No arboricultural information has been provided to support this application to ensure that the TPO tree would not adversely be affected. This is contrary to the recommendations of BS5837:2012 and the Council's own requirements. The proposal therefore fails to assess the arboricultural implications of the proposal, contrary to the requirements of Policy DM6 of the Elmbridge Development Management Plan 2015 and the NPPF 2024.

We request consideration of two informatives should planning permission be granted. Firstly, that use of the building as a separate self-contained accommodation or for primary living accommodation such as a bedroom is not permitted as the CIL Application Form states that the development is not for a new dwelling including a residential annex. Secondly, adjacent trees are protected by TPOs including their root systems from damage and harm and undertaking unauthorised works that cause damage to protected trees is an offence under the Town &Country Planning Act 1990. Hence, we believe that a Planning Application for protection of adjacent trees may be required.

EBC VERDICT: Refuse Planning Permission.
The proposed development, by reason of its mansard type roof does not represent good design, and its scale and bulk results in a visually prominent and incongruous form of development that would cause unacceptable harm to the appearance and character of the streetscene and local area. As such, the proposal would be contrary to Policies CS11, CS17 of the Core Strategy 2011, Policies DM2 of the Development Management Plan 2015 and the NPPF 2023.
